Terms and Conditions

1. Introduction

Welcome to Oceanvoyexias. These Terms and Conditions govern your use of our website, consultation services, cruise planning process, and arrangements entered into with Oceanvoyexias in Hong Kong.

Our website presents information about ten cruise options, consisting of one-day and multi-day journeys. Visitors may review cruise descriptions, general features, trip formats, and other relevant information before requesting a consultation.

The website is primarily an information and consultation platform. A cruise arrangement cannot be completed directly through the website. Instead, customers may request a consultation and meet with an Oceanvoyexias representative at our Hong Kong office. For any queries you can connect with us at travelpartners@oceanvoyexias.com.

By using our website, requesting a consultation, or accepting a cruise plan and quotation, you agree to the provisions applicable to that stage of your interaction with Oceanvoyexias.

2. Our Cruise Planning Model

Oceanvoyexias follows a consultation-based process rather than a direct website booking system.

The general process is:

  • Browse the ten cruise options displayed on our website.
  • Review the information relating to one-day and multi-day cruises.
  • Request a consultation through the website.
  • Attend the consultation at our Hong Kong office.
  • Discuss passenger requirements, intended dates, itinerary preferences, and requested facilities.
  • Receive a proposed cruise plan and quotation based on the information discussed.
  • Review the proposed arrangement before deciding whether to proceed.
  • Accept the applicable plan and complete the required arrangements through the process explained during consultation.

Submitting a consultation request does not itself create a cruise reservation.

3. Website Information

We aim to present cruise information in a clear and understandable manner. Cruise descriptions displayed online are intended to help visitors understand the available options before arranging an office consultation.

Website content may include information concerning:

  • Cruise duration
  • General itinerary format
  • Passenger arrangements
  • Available facilities
  • Departure information
  • Onboard features
  • One-day or multi-day formats
  • General planning considerations

Specific arrangements depend upon the plan discussed during consultation and subsequently accepted by the customer.

Photographs, illustrations, layouts, and descriptive materials appearing on the website may be used for presentation purposes. The written plan supplied following consultation should be reviewed when determining what forms part of a particular arrangement.

4. Consultations

A consultation request allows the customer to meet with an Oceanvoyexias representative at our Hong Kong office.

During the consultation, customers should provide accurate information regarding their intended journey and relevant passenger requirements. This allows the representative to identify feasible cruise options and prepare an appropriate proposal.

Customers should disclose relevant requirements before accepting their proposed plan. Requests introduced after acceptance may be considered as changes and will therefore be subject to the modification provisions below.

A consultation request does not oblige either party to enter into a cruise arrangement.

5. Cruise Plan and Quotation

Following the consultation, Oceanvoyexias may provide a proposed plan and quotation reflecting the requirements discussed.

Customers should review the following before acceptance:

Item What to Review
Cruise Selected cruise option
Duration One-day or multi-day format
Schedule Proposed departure details
Passengers Number and applicable passenger information
Itinerary Included journey arrangements
Facilities Items included in the proposed plan
Charges Amounts applicable to the arrangement
Conditions Relevant booking requirements

The customer's accepted plan, quotation, and these Terms should be read together when determining the agreed arrangement.

6. Customer Responsibilities

Customers are responsible for providing complete and accurate information during consultation and throughout the planning process.

Passengers must comply with applicable immigration, port, maritime, customs, identification, and travel-document requirements relevant to their journey.

Where a cruise itinerary requires identification, visas, permits, entry documents, or other passenger documentation, obtaining and maintaining the required documents remains the passenger's responsibility unless the written plan expressly states otherwise.

Oceanvoyexias may request information reasonably necessary for arranging or administering the cruise.

7. Changes to an Accepted Plan

Requests to modify an accepted cruise plan must be communicated to our team at least 72 hours before the scheduled departure time.

Modification requests may include changes concerning dates, passenger arrangements, itinerary preferences, or requested facilities.

A requested modification is not automatically incorporated into the existing plan. Oceanvoyexias will assess whether the requested change can be accommodated.

A change may affect availability, scheduling, operational arrangements, or the quoted amount. Where this occurs, the revised details will be communicated to the customer before the modification proceeds.

Requests received less than 72 hours before departure may not be accommodated.

8. Customer Cancellations

All cancellation requests must be sent to the Oceanvoyexias team by email. The timing of the written request determines the applicable cancellation outcome.

Cancellation Timing Applicable Outcome
At least 48 hours before the accepted departure time Full refund
Less than 48 hours before the accepted departure time 50% cancellation fee
Passenger does not appear for departure No-show terms apply

For calculating the cancellation period, Oceanvoyexias will use the accepted departure time stated in the applicable cruise plan and the time at which the cancellation email is received.

Where a 50% cancellation fee applies, the remaining 50% of the amount paid for the affected arrangement will be returned in accordance with the applicable refund process.

9. No-Show Terms

A customer or passenger who fails to appear for the scheduled departure without completing an applicable cancellation beforehand will be considered as a no-show.

A no-show results in forfeiture of the entire amount paid for the affected cruise arrangement. No refund will be issued in these circumstances.

Passengers should therefore review their departure details in advance and allow sufficient time to comply with applicable embarkation procedures.

10. Operational Changes

Cruise operations may occasionally be affected by circumstances outside ordinary planning, including weather conditions, port restrictions, maritime directions, route limitations, governmental requirements, operational disruption, or events beyond reasonable control.

Where an itinerary must be adjusted, Oceanvoyexias may communicate an alternative arrangement where reasonably available.

Nothing in these Terms is intended to remove or restrict rights that cannot lawfully be excluded under Hong Kong law.

11. Conduct and Passenger Requirements

Passengers must follow applicable onboard rules, maritime requirements, crew instructions, port procedures, and lawful directions applicable to the journey.

Conduct that creates significant disruption, interferes with vessel operations, breaches applicable law, or materially affects other passengers may result in appropriate action being taken according to the circumstances.

Passengers remain responsible for their personal belongings during the journey, subject to rights and obligations arising under applicable law.

12. Personal Data and Privacy

Oceanvoyexias may collect personal data when visitors submit consultation requests, communicate with our team, attend consultations, request changes, or proceed with cruise arrangements.

Personal data will be handled in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) and its applicable Data Protection Principles.

Information collected may be used for purposes including:

  • Managing consultation requests
  • Communicating with customers
  • Preparing proposed itineraries
  • Administering accepted cruise arrangements
  • Processing cancellation or modification requests
  • Maintaining relevant business records
  • Meeting applicable legal obligations

Personal data should not be retained longer than necessary for the relevant purpose, subject to applicable legal and operational requirements.

Customers may exercise applicable rights relating to access and correction of their personal data under Hong Kong privacy law.

Further information should be read together with the Oceanvoyexias Privacy Policy.

13. Hong Kong Consumer and Contract Framework

These Terms operate subject to applicable Hong Kong legislation.

The Trade Descriptions Ordinance (Cap. 362) applies to trade practices concerning goods and services and addresses matters including false trade descriptions, deceptive omissions, aggressive commercial practices, bait advertising, bait-and-switch practices, and wrongly accepting payment.

The Supply of Services (Implied Terms) Ordinance (Cap. 457) may apply to relevant service arrangements.

The Control of Exemption Clauses Ordinance (Cap. 71) regulates contractual provisions that seek to restrict or exclude certain liabilities.

The Unconscionable Contracts Ordinance (Cap. 458) provides protections concerning applicable consumer contracts whose terms or circumstances fall within its provisions.

The Electronic Transactions Ordinance (Cap. 553) provides the statutory framework relevant to electronic records and transactions in Hong Kong.

The Personal Data (Privacy) Ordinance (Cap. 486) applies to the handling of applicable personal data.

Nothing contained in these Terms is intended to exclude statutory rights where such exclusion is not permitted under Hong Kong law.

14. Website Use

Users must not misuse the Oceanvoyexias website or attempt to interfere with its operation.

Website materials, including written content, graphics, layouts, cruise descriptions, visual materials, and other original content, may be protected by applicable intellectual property laws.

Website access does not transfer ownership of Oceanvoyexias content to visitors.

Users may view website materials for personal informational purposes connected with considering our cruise services. Commercial reproduction, redistribution, or unwanted publication may be restricted by applicable law.

15. Third-Party Services

Certain cruise arrangements may involve vessel operators, port facilities, transport providers, hospitality providers, or other external service providers.

Where third-party services form part of an accepted plan, relevant external terms or operational requirements may also apply. Customers will be informed of material requirements where applicable to their arrangement.

Oceanvoyexias remains subject to obligations imposed upon it under applicable Hong Kong law.

16. Limitation of Liability

To the extent permitted by applicable law, Oceanvoyexias will not be responsible for losses arising solely from circumstances outside its reasonable control or from a customer's failure to provide accurate information, meet applicable passenger requirements, or comply with agreed departure arrangements.

Nothing in this section excludes or restricts liability where doing so would be prohibited under Hong Kong law, including applicable requirements under the Control of Exemption Clauses Ordinance (Cap. 71).

17. Updates to These Terms

Oceanvoyexias may revise these Terms when reasonably necessary to reflect changes to our website, consultation procedures, cruise arrangements, operational practices, or applicable legal requirements.

The version applicable to an accepted arrangement will be determined according to the terms communicated in connection with that arrangement and applicable law.

Changes will not retrospectively remove statutory rights available to customers.

18. Governing Law and Jurisdiction

These Terms and any contractual relationship between Oceanvoyexias and a customer are governed by the laws of the Hong Kong Special Administrative Region.

Any dispute arising from these Terms or an accepted cruise arrangement will be subject to the jurisdiction of the courts of Hong Kong, except where applicable law provides otherwise.

19. Contact and Formal Requests

Questions concerning these Terms, an existing cruise arrangement, modification requests, or cancellation requests should be directed to Oceanvoyexias through the contact details published on our website.

Cancellation requests must be submitted by email so that the date and time of the request can be recorded.

Customers should include sufficient booking information in their correspondence to allow the relevant arrangement to be identified. You can connect with us at travelpartners@oceanvoyexias.com.

20. Acceptance of These Terms

Using the website does not by itself create a completed cruise reservation.

A cruise arrangement progresses through consultation, proposal, quotation, and customer acceptance. Once a customer accepts the applicable cruise arrangement, these Terms, together with the accepted plan and quotation, form part of the contractual framework between the customer and Oceanvoyexias.

Customers should review all applicable documents before accepting their cruise arrangement.
